How FLSA Overtime Works

Under the Fair Labor Standards Act (FLSA), most employees must receive overtime pay at a rate of at least 1.5× their regular rate for all hours worked over 40 in a workweek.

Overtime Pay = (Hours Over 40) × Hourly Rate × 1.5

Most hourly workers and salaried employees earning less than $684/week ($35,568/year) are entitled to overtime.

✗ Exempt Employees

Executive, administrative, professional, and outside sales employees earning above the salary threshold are generally exempt.

Example Calculation

An hourly employee earning $18/hour who works 47 hours in a week:

Regular pay: 40h × $18.00 = $720.00

Overtime pay: 7h × $27.00 (1.5×) = $189.00

Total weekly pay: $909.00

State Overtime Laws

Some states have stricter overtime rules than federal FLSA. California, for example, requires overtime after 8 hours in a single day (not just 40 hours per week). Alaska and Nevada have similar daily overtime rules. Always check your state law — whichever is more generous to the employee applies.
